Cultured Marble Care & Warranty
INHERENT
PROPERTIES Cultured
marble manufacturing is a very imperfect science. We have instituted many procedures to insure a consistent
product. Listed below are
several inherent characteristics that are beyond our control. HAIRLINE
SCRATCHES Whether
they are inward or outward, they are considered normal; customer
maintenance is recommended to buff these scratches out as necessary. IRREGULAR
GRAINING OR COLOR For
each square foot of marble a percentage of pigment is added.
Although it may be dispersed in a wide range of graining, this
effect gives each product a character of its own.
Patrician Marble Company cannot control the results of either color
or graining. GEL
COAT Gel
Coat, the outermost skin, is prone to varying degrees of inconsistencies:
SPECKS
OR IMPURITIES Specks
or impurities are considered normal.
Lampblack, which is mined with limestone (our basic material), is
inherent. Lampblack can
create small black spots in the final product.
These specks filter down during the mixing stage and are impossible
to identify prior to manufacturing. Very
large stones are removed prior to delivery of the finish product. Small specks are considered normal and remain in the final
product. THERMAL
SHOCK Rapid
changes of temperature from 50 F to 70 F may cause cracking. This thermal
shock effect can be controlled by keeping marble at room temperature
between 65 and 80 degrees farenheit and controlling water heater
temperature to approximately 120 degrees farenheit.
Please fill sink with cold or warm water before running only hot
water into sink. FOB
WORK It
is the responsibility of all FOB customers to look over all material at
the time it is picked up. If
any defects are found they should be noted on the invoice before the
material leaves the Patrician Marble Company facility.
Once the material has left the shop the FOB customer has excepted
the material as good material. Any
repairs in the field will be subject to the standard Patrician Marble
Company service charges for repairs needed in the field. ADDITIONAL
INFORMATION In
the event of chips or deep scratches in the surface of Cultured Marble or
Granite product, Patrician Marble Company offers an expert repair service
to accommodate your needs. Service charge is $65.00 per-hour, with a
$65.00 minimum charge trip charge. Contact

WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING,
WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A
PARTICULAR PURPOSE. THE REMEDY OF
REPLACEMENT IS THE SOLE AND EXCLUSIVE REMEDY FOR SELLER’S OBLIGATIONS ARISING
FROM THE SALE OF ITS PRODUCTS. IN NO CASE WILL SELLER BE LIABLE FOR INCIDENTAL
OR CONSEQUENTIAL LOSS OR DAMAGE, including without limitation, costs of
installation, removal or re-installation, damage to other property, loss of
profits, loss of goodwill, or other economics loss, whether such incidental or
consequential loss or damage is claimed on account of breach of warranty, breach
of contract, negligence, strict liability in tort, or any other legal theory.
GOODS SOLD FOR RESALE ARE ALL SUBJECT TO THESE TERMS, AND ALL OFFERS ARE
EXPRESSLY CONDITIONED UPON ACCEPTANCE OF THESE TERMS. 1)
Patrician
Marble Company is located at 3333 W. Osborn, Phoenix, Arizona 85017 and is the
warrantor of 2)
This
limited warranty is extended to and enforceable by those original consumer
purchasers that have 3)
This
limited warranty covers: 4)
In the
event there is a defect of the type described during the time specified in
paragraph 3 (a) or (b), Patrician 5)
The
procedure the original consumer must follow:
The consumer has the obligation to notify Patrician Marble If the defect is of the type described in paragraph 3
(a) or (b) and was not originally installed by Patrician Marble Company, the
consumer must bear the labor expenses incurred in both removal of the defective
product and installation of the replacement or repaired product. 6)
Structural
defects and factory workmanship defects shall not include: 7)
Patrician
Marble Company will perform its obligations under the limited warranty as soon
as practicable. Warrantor’s determination as to what constitutes a defect, not
otherwise disclaimed, is not final. In the event the consumer disputes
warrantors determination that a valid claim does not exist, the consumer may
pursue any rights and remedies, which he may have under the law. 8)
Additional
limitations and exclusions under this warranty shall include: a)
Consequential,
indirect and incidental damages
incurred by the consumer as a result of any breach by warrantor of any written
or implied warranty are specifically excluded under this warranty.
The consumer’s damages are limited to repair and replacement of product
or refund as set in paragraph 4 regarding 3 (a) and (b) defects.
Some states so not allow the exclusion or limitation of incidental or
consequential damages, so the above limitation or exclusion may not apply to
you. b)
This
limited warranty gives you specific rights, and you may also have other rights,
which vary state to state. |
